Who Pays the Commission?
· The Seller Does
Generally, the Seller has signed a listing agreement specifying with his agent a certain fee to be paid. Regardless of buyer or sub agency, many times the agreement has provisions for splitting that fee with the agent who sells the property.
· The Buyer Does
As in the written agreement, the Buyer can pay his agent commission. If the buyer chooses to do so, accepting any portion of the fee the seller pays for would be inappropriate for the buyer’s agent.
· The Buyer Does Indirectly
It has been argued that the buyer pays the commission as part of the overall purchase price, even though the seller pays the commission using his proceeds. This holds an assumption that had it not been listed, the buyer could have purchased the home for less.
· Each Party Pays Their Agent
As specified in the written agreement, each party pays their agent.
